400-408Jordon Lorence, senior attorney with the Alliance Defense Fund (telladf.org), on ADF's appearance before the California Supreme Court this morning at 9:00am to argue in favor of Proposition 22, the California's Defense of Marriage Act, that passed by a margin of 61.4/38.6% back on March 7, 2000, that said simply, "Only marriage between a man and a woman is valid or recognized in California."  Prop 22 won 52 of 58 counties, including every major metropolitan areas except San Francisco.  The six counties which did not pass Prop. 22 were all in the greater Bay area:  Alameda, Marin, San Francisco, Santa Cruz, Sonoma, and Yolo.
How States Treat Same Sex Couples
(1) Same-sex marriage legal:  Massachusetts.
(4) Civil unions, with most of the spousal rights:  Vermont, Connecticut, New Jersey, New Hampshire.
(2) Domestic partnerships, with most of the spousal rights: California, Oregon.
(26) Constitutional amendments outlawing same-sex marriage:  Alabama, Alaska, Arkansas, Colorado, Georgia, Idaho, Kansas, Kentucky, Louisiana, Michigan, Mississippi, Missouri, Montana, Nebraska, Nevada, North Dakota, Ohio, Oklahoma, Oregon, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, Wisconsin.
(12) Statutes outlawing same-sex marriage:  Arizona, California, Hawaii, Illinois, Indiana, Iowa, Maine, Minnesota, North Carolina, New Hampshire, Pennsylvania, West Virginia.
•• Go to protectmarriage.com and sign the petition!  They need 694,354 valid signatures by April 1st to qualify the initiative for the November ballot.
The arguments on both sides are weighty.
Supporters of same-sex marriage invoke the state's commitment to equality regardless of gender or sexual orientation, the needs of the children of gay and lesbian couples, the persistence of societal discrimination, and legal rights such as freedom of expression, association and privacy.
In defense of its law, the state cites a cultural tradition far older than statehood, the will of the people as expressed in a 2000 initiative, the steps California has already taken toward equal rights for gays and lesbians, and the power of lawmakers and voters to determine state policy.
Beyond those arguments, groups opposing same-sex marriage want the court to justify the state law on moral or scientific grounds, as an affirmation that limiting matrimony to a man and a woman is best for children and society.

(:52) Barack, "I will tell you that I don't believe in gay marriage, but I do think that people who are gay and lesbian should be treated with dignity and respect and that the state should not discriminate against them.  So, I believe in civil unions that allow a same-sex couple to visit each other in a hospital or transfer property to each other.  I don't think it should be called marriage, but I think that it is a legal right that they should have that is recognized by the state. If people find that controversial then I would just refer them to the Sermon on the Mount, which I think is, in my mind, for my faith, more central than an obscure passage in Romans. That's my view."

• AP, California High School Football Star Gunned Down in Random Gang Attack.  Jamiel Andre Shaw, 17, the Southern League's MVP last year as a running back at Los Angeles High School, was killed by gang members when he wouldn't answer "Where you from?"  His mother, Army Sgt. Anita Shaw is on her way back from Iraq where she is fighting.

628-639 • AP, Strip club: 'Idol' once danced here.  "American Idol" contestant David Hernandez once entertained audiences by removing his clothes instead of singing tunes, a manager at a male strip club in Phoenix told The Associated Press.  The 24-year-old finalist from Glendale, Ariz., once worked as a stripper at Dick's Cabaret, appearing fully nude and performing lap dances for the club's "mostly male" clientele, club manager Gordy Bryan said Monday.  He was also a bartender in the gay nightclub "Burn."
