"The government should promote and encourage strong families.  The only way to make sure it does so in California is to amend the state constitution to protect marriage.  That's ultimately the only avenue to ensure that no one interferes with the will of the people," said ADF Senior Counsel Glen Lavy, who argued before the court.  

"The ruling from the court today ignores the will of the people of California who approved Proposition 22.  The voters realize that defining marriage as one man and one woman is important because the government should not, by design, deny a child both a mother and father," Lavy explained.  "The court's decision clearly demonstrates that marriage is not ultimately safe from tampering by activists and others in government until the voters have amended the constitution."
• FRC, CA Supreme Court Imposes Same-sex 'Marriage,' Overturning Prop. 22:  Ruling Underscores importance of November's Ballot Initiative Protecting Marriage.  The 4-3 decision trumps the 4,618,673 California voters who voted for Prop 22 back in 2000, which was approved by 61% of the voters.  Tony likens it to a "judicial shotgun wedding."
Writing for the majority, Chief Justice Ronald George, said: "In light of the fundamental nature of the substantive rights embodied in the right to marry--and their central importance to an individual's opportunity to live a happy, meaningful, and satisfying life as a full member of society--the California Constitution properly must be interpreted to guarantee this basic civil right to all individuals and couples, without regard to their sexual orientation."

  George also noted that "in contrast to earlier times, our state now recognizes that an individual's capacity to establish a loving and long-term committed relationship with another person and responsibly to care for and raise children does not depend upon the individual's sexual orientation..."
"Limiting the designation of marriage to a union 'between a man and a woman' is unconstitutional and must be stricken from the statute," California Chief Justice Ron George said in the written opinion.  The ruling added that all California couples had a "basic civil right" to marry "without regard to their sexual orientation."

On March 4, 2008, Mathew D. Staver, Founder of Liberty Counsel and Dean of Liberty University School of Law, presented oral argument at the California Supreme Court in defense of the marriage laws. The court hearing lasted more than three hours, as each side debated the issue. Liberty Counsel became involved in February 2004.
Commenting on today's ruling, Mathew Staver said: "This ruling defies logic. It is a gross departure from the rule of law. It is outrageous. Traditional marriage is common sense. Yet, this decision is nonsense. No matter how you stretch California's Constitution, you cannot find anywhere in its text, its history, or tradition that now, after so many years, it magically protects what most societies condemn. Same-sex marriage is not part of our history nor is it woven in the fabric of fundamental freedom. The California Supreme Court has defied logic, undermined the will of the people, and weakened our future. This decision will ignite California voters to amend their state constitution to protect marriage and prevent judges from wrecking marriage."

"In 1863, Abraham Lincoln said in the Gettysburg Address that ours is a government 'of the people, by the people and for the people.' Well, not in the state of California, where four imperious and unelected justices have just overridden the will of the voters. In 2000, Proposition 22 defined marriage as being exclusively between one man and one woman; the initiative passed by an overwhelming margin of 61 to 39 percent. That emphatic expression of the will of the people has now arrogantly been declared null and void.
"In so doing, the justices have undermined and endangered the basic building block of society, which has been honored and preserved in every nation on earth through most of human history. What an outrage. It will be up to the people of California to preserve traditional marriage by passing a constitutional amendment in the November elections. Only then can they protect themselves from this latest example of judicial tyranny."

Dr. Ergun Caner, President of Liberty Baptist Theological Seminary and Graduate School ("Seminary"), was shocked to learn that his name was listed as one of the "Charter Signatories."  Dr. Caner has publicly repudiated the document's anti-activism position. The EM's web site also erroneously lists Dr. Jerry Falwell as a signatory. Jerry Falwell, Jr., the Chancellor of Liberty University, responded to the error: "As the founder of the Moral Majority, dad would not endorse a document that appears to undercut political activism. My dad was a man of courage who paved the way for a generation of socially conservative activists. He never backed away from his resolve to please God. He was a tireless defender of the sanctity of human life and family values."  Mathew D. Staver, Founder of Liberty Counsel and Dean of Liberty University School of Law, commented: "The Evangelical Manifesto does not represent the views of Dr. Jerry Falwell, Dr. Ergun Caner, Liberty University, or, for that matter, the majority of evangelicals. While some might shy away from the public square, most evangelicals do not. Life and marriage are nonnegotiable. While our discourse must be civil and our compassion must be genuine, our resolve must never waiver."

• We Get It!, (we-get-it.org) "We Get It!" Campaign Kicks Off Effort to Enlist One Million Signers On Landmark Statement:  New Declaration Embraces Biblical Stewardship but Rejects Environmental Hype that Threatens the Poor.
The We Get It! Declaration:
God Said It – God created everything. He made us in His own image, and commanded us to be fruitful and multiply and watch over His creation. Although separated from God by our sin, we are lovingly restored through Jesus Christ, and take responsibility for being good stewards.
We Get It – Our stewardship of creation must be based on Biblical principles and factual evidence. We face important environmental challenges, but must be cautious of claims that our planet is in peril from speculative dangers like man-made global warming.
They Need It – With billions suffering in poverty, environmental policies must not further oppress the world's poor by denying them basic needs. Instead, we must help people fulfill their God-given potential as producers and stewards.
Let's Do It – We will follow our Lord Jesus Christ and honor God as we use and share the principles of His Word to care for the poor and tend His creation.
