At a time when workers' pay and benefits have stagnated, federal employees' average compensation has grown to more than double what private sector workers earn, a USA TODAY analysis finds.

Federal workers have been awarded bigger average pay and benefit increases than private employees for nine years in a row. The compensation gap between federal and private workers has doubled in the past decade.

Federal civil servants earned average pay and benefits of $123,049 in 2009 while private workers made $61,051 in total compensation, according to the Bureau of Economic Analysis. The data are the latest available.

The federal compensation advantage has grown from $30,415 in 2000 to $61,998 last year.

528-538 Mat Staver founder of Liberty Council (lc.org), and dean of the Liberty University School of Law (law.liberty.edu), whose latest book is Same Sex Marriage: Putting Every Household at Risk.  Today we talk about the strategy of how Prop 8 was argued, and now its uncertain path to the Ninth Circuit.  Mat says that the strategy to not engage the merits of traditional marriage over same-sex marriage in district court has proven to be a failed strategy.  Judge Walker put marriage itself on trial, but because we didn't engage those arguments, we can not now bring them up on appeal – since all evidence is entered at the district level, and appellate courts rule on whether the judge made an appropriate decision based upon the evidence.  The likelihood of new "pro-traditional marriage" evidence being admitted via amicus at the Ninth is slim.  There were a number of experts that could have been called in defense of marriage, but were not, because the strategy was not to argue the merits of marriage itself, but rather, the constitutionality of Prop 8.  That strategy clearly failed.  Now, the proponents of same-sex marriage are eager to see the case appealed to the Ninth, and ultimately to SCOTUS, because of the strength of Walker's decision – written with Justice Kennedy in mind.  Perhaps the wise course is to not appeal this case, since a loss at SCOTUS would overturn the laws in 30 states that prohibit same-sex marriage.

// Mathew Staver, Founder of Liberty Counsel and Dean of Liberty University School of Law, commented: "It is outrageous that Judge Walker refused to stay his ruling. This is a classic example of radical individualism and judicial activism. Judge Walker obviously has not learned the lesson of 2008, when the California Supreme Court refused to stay its decision on marriage. That decision was reversed in short order, but it caused a huge disruption. Staying the effect of Judge Walker's ruling pending the appeal is the only logical thing to do in this case. This case has a high probability of being overturned on appeal. It makes no sense for one person to set aside a state constitutional amendment, radically change the longstanding status quo, and then later be reversed. The disruption will be enormous if this decision is not stayed. In the end, the commonsense and constitutional definition of marriage as one man and one woman will be upheld."
